Additional Terms. Sponsor, together with Call it Magic Productions, reserves the right to modify or cancel a Giveaway at any time. Call it Magic Productions and its affiliates are not responsible for: (a) lost, misdirected, late, or incomplete entries or for inaccurate entry information; (b) any operation or transmission error, theft, unauthorized access to, or alteration of, entries; or (c) damage to any computer or device resulting from downloading Giveaway materials. Call it Magic Productions may disqualify any individual found to be: (x) tampering with a Giveaway; (y) violating these Terms & Conditions; or (z) acting in an unsportsmanlike or disruptive manner or with intent to threaten or harass any person. Incomplete and robotic, automatic, programmed or similar entries will be disqualified. 

Call it Magic Productions may award the prize(s) by random drawing from among all eligible claimants. All prizes made available for a Giveaway may not be awarded in the event Call it Magic Productions does not receive a sufficient number of qualified and eligible entries for an applicable Giveaway. Miscellaneous. Each Giveaway is governed by the laws of the United States. By entering a Giveaway, you agree (for yourself and your heirs) that Call it Magic Productions, and each of their respective affiliates and agents, and any entity involved in any aspect of the Giveaway (all aforementioned parties are collectively, the “Released Parties”) will have no liability, and will be held harmless from and against liability, loss, injury or damage to property or person, including death, and reasonable attorney’s fees and court costs, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or misuse of a prize or participation in the Giveaway even if caused or contributed to by the negligence of any of the Released Parties. By entering this Giveaway, entrant is indicating his/her agreement to be bound by these terms and conditions.

Entire Agreement: This agreement contains the entire understanding between the Giveaway winners, also referred to as the Clients and Call it Magic Production, also referred to as the Photographer/Videographer. Travel Expenses: Client(s) agrees to pay all of photographer(s)/Videographer(s) travel expenses which may include, but is not limited to, the following: air fare, rental car, gas, bus fare, taxi fare, Uber fare, Lyft fare, hotel accommodations, meals, and all other expenses accrued during travel. Photographer(s)/Videographer(s) must provide proof of purchases to client(s) in order to be reimbursed for expenses accrued. Client(s) are not responsible for personal expenses accrued by Photographer(s)/Videographer(s) during travel. Reimbursements are due no later than 7 days after wedding date. Pre-Event Consultation: Call it Magic Productions does not require a consultation. This normally happens at the time of booking. The Clients will outline broadly what is required and the Photographer/Videographer will advise on planning, logistics and timings where needed. If required the Clients are welcome to pop in for an additional chat closer to the time of the event (approximately 2 weeks prior to event) to iron out the remaining details. In any case we will contact you by phone a few days before the event to ensure that there have been no last minute changes. Client(s) my only upgrade/ add on additional services. Cooperation: The Clients and the Photographer/Videographer consent to happily cooperating and communicating with each other to achieve the best possible result within the understanding of this contract. The Clients also agree to give the Photographer/Videographer sufficient warning of key events at the event to give the Photographer/Videographer time to prepare e.g. Bouquet throwing, cutting the cake, speeches etc. Please note that not all guests at events like having their photo/video taken. In such cases the Photographer/Videographer will use his discretion but cannot be held responsible for a lack of footage of these people. The Schedule: Our shooting schedule, style of working and experience are designed to achieve a great set of event photos/video for the Clients, accomplished with good humor and enjoyed by all concerned. Both the Clients and the Photographer/Videographer therefore agree that punctuality and cheerful cooperation are essential to producing outstanding results. In cases where the event does not run on time (for example, extreme lateness by one of the Clients arriving to the church) we cannot guarantee to take our normal set of photos/video although in such circumstances we will do our absolute best to compensate. If tardiness of the Clients occurs, the start and end time will not be adjusted. Paparazzi Event Guests: All your guests will have digital cameras and all your guests will want to photograph/video record the Clients. In the spirit of cheerful cooperation the Clients agree to give the Photographer/Videographer precedence over the guests in order to capture photos/video required for the event services described above. We cannot be held liable for a lack of event photos/video footage if guests taking their own photos/video of the Clients continually interrupt the Photographer/Videographer's work. House Rules: Note the Photographer/Videographer are sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example some ministers insist that no flash photography is allowed, and others will insist that the Photographer(s)/Videographer(s) shoot from a specific location. In such circumstances the Clients agree to accept the technical limitations that may be imposed on the equipment used. We advise the Clients to make themselves aware of the rules of the venue concerned and if necessary negotiate with the personnel concerned. Copyright Law: The copyright of photos/video remains with the Photographer/Videographer. The Photographer/Videographer grants the Clients permission to make copies of the images under the following conditions. The images captured by the Photographer/Videographer are for personal use by the Clients and their friends and relatives. Sale, Publication or any Commercial use of photos and video is not allowed without prior written permission from the Photographer/Videographer. Model Release: The Clients grant the Photographer/Videographer and its legal representatives, heirs and assigns, the irrevocable and unlimited consent to use the photos/video of the Clients for editorial, competition, advertising and any other purpose and in any manner, to alter the photos/video without restriction; and to copyright the images. The Clients hereby release the Photographer/Videographer and its legal representatives, heirs and assigns from all liability and claims in connection with the images. Print Release: Call it Magic Productions is the rightful copyright owner of the digital images and video received. Call it Magic Productions authorizes the client(s) to print these files. Original copyright remains with Call it Magic Productions. The photos may be printed but not altered or edited in any way other than by the photographer and alterations is a violation of the copyright. Call it Magic Productions is not liable for print quality, cropping or coloring of any photos not printed directly through our professional lab. Photo quality is only guaranteed through photos purchased directly through the lab of Call it Magic Productions. Proper recognition of Call it Magic Productions is appreciated and requested when publishing photos and using them online (example-like when putting them on Facebook). Photos may not be entered into any contest without prior consent of Call it Magic Productions and without proper credit to Call it Magic Productions, Limit of Liability: If a Photographer/Videographer is too ill or becomes injured and cannot supply the event services specified above the Photographer/Videographer will try to book a replacement event Photographer/Videographer. Under normal circumstances a second Photographer/Videographer from the Photographer/Videographer is there for the day anyway and this Photographer/Videographer will then shoot the day on his/her own. If both Photographer/Videographer are unavailable and a replacement Photographer/Videographer cannot be found then liability is limited to a refund of any payments received. The Photographers/Videographers have working methods in place to prevent loss or damage to your images. However, there is the unlikely possibility that images may be lost, stolen or destroyed for reasons in or beyond our control. In these circumstances liability is limited to the return of fees paid for the service or part thereof according to the percentage of images supplied.Call it Magic Productions is not held accountable for the length of time it takes to receive photos/videos. Booking Fee/Deposit: In the event of the Clients cancelling the event for whatever reason the booking fee is non-refundable. It will be considered as liquidated damages to the Photographer/Videographer. Receiving your Photos/Video: Allow at least 8 weeks for editing. Once completed, your photos/video(s) will be shipped to the address provided above via USPS standard shipping or UPS ground or shared online contingent the package selection of the client. ​
